What is an impediment to enforcement?

An impediment to enforcement is a circumstance that may prevent a final refusal of entry or expulsion decision from being carried out. The issue normally arises after the decision can no longer be appealed and new circumstances have arisen or become known.
In some cases, the Swedish Migration Agency may grant a residence permit if there is a legal impediment, the receiving country will not admit the person, or medical or other special circumstances mean that the decision should not be enforced.
The circumstances usually need to be specific, current and supported by relevant evidence.
What circumstances may prevent enforcement?
Every case is assessed individually. Relevant circumstances may include:
- a new or increased risk of persecution, torture or other treatment giving rise to a need for protection
- a serious medical condition that prevents travel or reception in the destination country
- the receiving country’s refusal to admit the person
- new information concerning a child’s health, safety or circumstances
- other special circumstances that arose after the previous decision.
Repeating information that has already been examined is generally insufficient. You need to explain what is new, when it arose and why it prevents enforcement. New information concerning a need for international protection may need to be handled as a subsequent application for international protection.
How do you notify the Swedish Migration Agency?
There is normally no special form for presenting new circumstances. You can submit a signed letter to the Swedish Migration Agency containing:
- your name and case number
- a description of the new circumstances
- an explanation of why you cannot return
- your address and contact details
- documents supporting the information.
Supporting evidence may include medical certificates, official documents or other material showing what has changed.
Submitting information about an impediment does not automatically suspend the removal decision. There must be a decision on suspension of enforcement or another legal basis allowing you to remain during the examination. You should therefore establish promptly whether you are permitted to stay while the matter is being considered.

FAQ
Frequently asked questions about impediment to enforcement
There is normally no specific form. Instead, you submit a signed letter stating your case number, the new circumstances, why the decision cannot be enforced and your contact details. You should attach documents supporting the information.
No, not automatically. The Swedish Migration Agency must suspend enforcement, or you must have another legal right to remain while the matter is examined. You should check what applies in your particular case.
The required evidence depends on the circumstances. It may include medical certificates, reports concerning new threats, official documents or evidence that the receiving country will not admit you. The documents should demonstrate what is new and why it affects enforcement.
This depends on the type of decision and the procedure under which the matter was examined. Read the appeal instructions included with the decision and act within the stated deadline. A lawyer can assess whether the decision can be appealed and how to proceed.
