What is unlicensed driving?

Under Swedish law, a person who intentionally operates a vehicle requiring a license without being legally entitled to drive it may be convicted of unlicensed driving.
The allegation may arise if you:
- have never held the required license
- drive after your license has been revoked
- drive during a disqualification period
- operate a vehicle requiring a different license category
- ride a motorcycle or moped without the correct license
- drive a modified vehicle that falls within another vehicle category
The prosecution will generally need to establish that the act was intentional. If you believed that your license was valid or did not know that the vehicle required another category of license, the specific circumstances may need closer examination.
A person who permits someone else to drive without the required license may also face criminal liability.
Penalties for unlicensed driving
The standard offense is punishable by a fine. The outcome depends on the circumstances, including the type of license that was missing and whether the driver has previous traffic convictions.
The incident may also lead to a separate licensing matter. The Swedish Transport Agency may consider whether an existing license should be revoked or whether the offense should affect a future application for a learner’s permit or driver’s license.
It is helpful to distinguish between:
- the police and prosecutor’s criminal investigation
- the court’s decision on guilt and sentencing
- the Swedish Transport Agency’s separate licensing process
A summary penalty order that you accept generally has the same legal effect as a judgment. You should understand the allegation and its consequences before deciding whether to accept it.
When is unlicensed driving considered aggravated?
The offense may be classified as aggravated if the driver previously held a license that was revoked, repeatedly drives without authorization, or the circumstances otherwise make the offense serious.
Previous convictions and repeated incidents may have a significant impact on the assessment. Aggravated unlicensed driving is punishable by a fine or imprisonment for up to six months. The specific sentence depends on the circumstances of the case.
A vehicle used in repeated traffic offenses may also be seized and ultimately forfeited when this is necessary to prevent continued offending.
