LVU can be applied in Sweden when there are serious issues in the child’s home environment. This can include situations where the child lives in an environment that’s harmful to their health or development, such as when parents abuse substances or suffer from mental illness. It can also be applied when the child is exposed to violence and/or neglect. In such cases, social services can apply for care of the child under LVU.

They can also do so if the child exhibits destructive behaviors that endanger their health or development, such as substance abuse or engaging in criminal activities, and refuses to accept help voluntarily. In these cases, social services can apply for compulsory care of the child under LVU.

The process and care of the child

Report and investigation
When social services become aware that a child is at risk, they’ll initiate an investigation. They’ll consult with the school, healthcare providers, and others who may have important information about the child.

Decision on care
If social services determine that the child needs compulsory care, they’ll apply for it at the administrative court. The administrative court will then make a decision on LVU placement as care of the child after hearing from both the child and the parents.

Appeal
The child and the parents have the right to appeal the decision. They can do so to the Court of Appeal and, as a last resort, to the Supreme Administrative Court.
