Do you want to report medical malpractice in Sweden?

medical malpractice

Experiencing medical malpractice can be a challenging ordeal. It’s important to know that you have the right to report medical malpractice and have it reviewed by relevant authorities. Medical malpractice is governed by the Swedish Patient Safety Act, and by filing a report, you can help improve healthcare practices to prevent similar incidents in the future.

What Is medical malpractice?

The Swedish Patient Safety Act defines medical malpractice as harm or suffering caused by an action within healthcare or by deficiencies in care. Examples include incorrect medication, delayed treatment, or injuries during surgical procedures. The objective of this legislation is to ensure safe and reliable healthcare.

How to report medical malpractice in Sweden

To report medical malpractice, you must first gather all relevant information about the incident. You can then file a report with The Health and Social Care Inspectorate (IVO). IVO provides a specific form for this purpose, which you can submit either digitally or by mail. You can also report directly to your healthcare provider, who is obligated to investigate the matter and follow up on what has occurred.

  • Collect medical records and other relevant documentation.
  • Contact IVO and complete their form for reporting malpractice.
  • Follow up with your healthcare provider regarding the investigation.

Which authorities handle medical malpractice?

The two main authorities managing malpractice cases are the The Health and Social Care Inspectorate (IVO) and the Swedish patient insurance (LÖF). IVO is responsible for examining and investigating incidents from a patient safety perspective. LÖF can assist you in applying for financial compensation if the harm meets the criteria. You can also receive support from the patient advisory board in your region for guidance during the process.

What happens after your report?

When you decide to report medical malpractice, the authority will assess your case. You’ll receive a confirmation once the investigation begins. The process may involve interviews with healthcare providers and a review of medical records. If IVO determines that a regulatory violation occurred, the healthcare provider may face mandatory measures or other actions. If you file for compensation through LÖF, they will conduct a separate evaluation for financial reimbursement.
