What is a legal dispute?

A legal dispute arises when two or more parties disagree about their rights or obligations. It may concern a contract, an unpaid debt, work or services performed, property damage or a claim for compensation.
The first step is usually to assess:
- what the parties agreed
- which claims and objections have been raised
- what evidence is available
- whether any deadlines or limitation periods apply
- the potential costs and risks of each course of action.
An early legal assessment can help define the issues and identify the most suitable way forward.
Can a dispute be resolved without going to court?
Many disputes can be resolved through direct negotiation or mediation. This gives the parties greater control over the outcome and may avoid the time, cost and uncertainty of court proceedings.
If the parties reach an agreement, the terms should be recorded in a clear settlement agreement. It should state what each party must do, when those obligations must be performed and which claims are finally resolved.
Settlement is not appropriate in every case. Before accepting an offer, you should understand which rights and claims you are giving up and what options remain if the dispute continues.
When does a dispute go to court?
If the parties cannot agree, the dispute may need to be decided by a Swedish district court. The claimant begins the proceedings by filing a claim, and the other party is then given an opportunity to respond.
The court reviews the parties’ requested outcomes, legal grounds and evidence. The case may end in a settlement during the proceedings or in a judgment following a main hearing.
Court proceedings involve financial risk. In an ordinary civil dispute, the unsuccessful party may have to pay both its own costs and the other party’s reasonable litigation costs. Recovery of costs is more limited in simplified civil disputes involving lower value claims.
You should also check whether your insurance includes legal expenses cover before starting or continuing a dispute.

FAQ
Frequently asked questions about disputes and dispute resolutions
It is sensible to seek assistance early if the dispute involves a significant amount, complex contract terms, uncertain evidence or a short deadline. A lawyer can also help you assess whether the likely cost and risk are proportionate to the claim.
Yes. Many disputes are resolved through negotiation, mediation or settlement. The appropriate method depends on the subject of the dispute, the relationship between the parties and their willingness to reach an agreement.
In ordinary Swedish civil cases, the general rule is that the unsuccessful party pays the other party’s reasonable litigation costs. Different and more limited rules apply to simplified civil disputes involving lower value claims.
Read the documents immediately and check the deadline for responding. If you do not respond in time, the court may issue a default judgment. Gather the relevant contract, correspondence and other evidence as soon as possible.
