D\u00e4rf\u00f6r \u00e4r det v\u00e4ldigt viktigt att du som arbetsgivare f\u00f6ljer de <a href=\"https:\/\/kliently.se\/en\/services\/labour-law\/\">arbetsr\u00e4ttsliga<\/a> reglerna noggrant. En upps\u00e4gning kan ske av olika anledningar, exempelvis p\u00e5 grund av avskedande, personliga sk\u00e4l eller arbetsbrist. Varje situation kr\u00e4ver en noggrann bed\u00f6mning och du beh\u00f6ver utr\u00e4tta upps\u00e4gningen p\u00e5 r\u00e4tt s\u00e4tt. Annars \u00e4r risken att ni m\u00f6ts av r\u00e4ttsliga konsekvenser och tvister l\u00e4ngre fram.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-pa-grund-av-avskedande\">P\u00e5 grund av avskedande<\/h2>\n\n\n\n<p>Att avskeda en anst\u00e4lld betyder att du som arbetsgivare avslutar anst\u00e4llningen p\u00e5 en g\u00e5ng, allts\u00e5 med omedelbar verkan. Du kan avskeda en anst\u00e4lld om hen har beg\u00e5tt ett allvarligt fel eller missk\u00f6tt sig p\u00e5 n\u00e5got s\u00e4tt. Det kan exempelvis handla om st\u00f6ld, v\u00e5ld, allvarliga brott mot f\u00f6retagets policy eller andra handlingar som g\u00f6r det om\u00f6jligt att l\u00e5ta anst\u00e4llningen forts\u00e4tta.<\/p>\n\n\n\n<p>Vid ett avskedande har den anst\u00e4llda inte r\u00e4tt till n\u00e5gon upps\u00e4gningstid eller l\u00f6n under upps\u00e4gningstiden. Det \u00e4r v\u00e4ldigt viktigt att du har tydliga bevis innan du anklagar den anst\u00e4llda f\u00f6r att ha missk\u00f6tt sig eller beg\u00e5tt ett fel och f\u00f6rs\u00f6ker avskeda hen.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-pa-grund-av-personliga-skal\">P\u00e5 grund av personliga sk\u00e4l<\/h2>\n\n\n\n<p>En upps\u00e4gning p\u00e5 grund av personliga sk\u00e4l kan ske om den anst\u00e4llda inte uppfyller sina arbetsuppgifter, har \u00e5terkommande samarbetsproblem, eller p\u00e5 annat s\u00e4tt inte lever upp till arbetsgivarens f\u00f6rv\u00e4ntningar. Men innan den anst\u00e4llda kan bli uppsagd m\u00e5ste arbetsgivaren ha f\u00f6rs\u00f6kt att r\u00e4tta till problemen, exempelvis genom utbildning eller samtal.<\/p>\n\n\n\n<p>Vid en upps\u00e4gning p\u00e5 grund av personliga sk\u00e4l har den anst\u00e4llda r\u00e4tt till upps\u00e4gningstid enligt anst\u00e4llningsavtalet eller g\u00e4llande kollektivavtal. Upps\u00e4gningen m\u00e5ste ocks\u00e5 ha en &#8220;saklig grund&#8221;. Det inneb\u00e4r att arbetsgivaren m\u00e5ste kunna visa att det finns en godtagbar orsak till upps\u00e4gningen.<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-uppsagning-pa-grund-av-arbetsbrist\">Upps\u00e4gning p\u00e5 grund av arbetsbrist<\/h2>\n\n\n\n<p>Arbetsbrist \u00e4r den vanligaste orsaken till upps\u00e4gning och kan uppst\u00e5 p\u00e5 grund av ekonomiska problem eller omorganisation hos f\u00f6retaget. Upps\u00e4gning p\u00e5 grund av arbetsbrist \u00e4r inte personligt relaterad till den anst\u00e4llda. Det handlar snarare om att f\u00f6retaget beh\u00f6ver minska sin personalstyrka.<\/p>\n\n\n\n<p>Vid en upps\u00e4gning p\u00e5 grund av arbetsbrist m\u00e5ste arbetsgivaren f\u00f6lja turordningsreglerna enligt <a href=\"https:\/\/www.riksdagen.se\/sv\/dokument-och-lagar\/dokument\/svensk-forfattningssamling\/lag-198280-om-anstallningsskydd_sfs-1982-80\/\">Lagen om anst\u00e4llningsskydd (LAS)<\/a>, d\u00e4r sist in \u00e4r f\u00f6rst ut.
