Various types<\/h2>\n\n\n\n

Non-negotiable claims<\/strong><\/strong>
These are the most common type and mean that the creditor has the right to demand payment from the debtor, such as invoices or loans.<\/p>\n\n\n\n

Bearer claims<\/strong>
These are transferable and can be assigned to another person. Examples include promissory notes and bills of exchange.<\/p>\n\n\n\n

Individual claims<\/strong>
These arise when a specific performance is required, such as the delivery of a particular good or service.<\/p>\n\n\n\n

The process<\/h2>\n\n\n\n

Establishing<\/strong>
Begin by formally documenting the claim, such as through a contract<\/a> or an invoice. Clearly specify the amount, the due date, and what the it pertains to.<\/p>\n\n\n\n

Reminders and debt collection<\/strong>
If the debtor fails to pay on time, send a payment reminder. If payment still isn’t received, you can hire a debt collection agency to recover the payment.<\/p>\n\n\n\n

Legal action<\/strong>
If reminders and debt collection efforts don’t lead to payment, you may pursue legal action. This could include filing a payment order with the Swedish Enforcement Authority<\/a> or taking the matter to court.<\/p>\n\n\n\n

Statute of limitations<\/h2>\n\n\n\n

A claim can expire if you don’t pursue it within a certain timeframe. The general statute of limitations for them in Sweden is ten years, but for consumer claims, it’s three years. To avoid losing your right to payment, make sure you pursue within the statutory timeframe.<\/p>\n\n\n\n
