Do you need help in an LVU case?<\/h1>\n\n<\/div>\n\t\t<\/div><\/div>\n\n\n\n

LVU, or the Care of Young Persons (Special Provisions) Act, is a Swedish law designed to protect children and young people under the age of 18 who are at risk and in need of help. The law can apply if the child is living in an environment harmful to their health or development, such as in LVU cases where parents abuse substances, suffer from mental illness<\/a>, or expose the child to violence and\/or neglect.<\/p>\n\n\n\n

Social services<\/a> can only initiate an LVU placement when other interventions are insufficient or when parents refuse to agree to necessary care. Additionally, LVU can apply if the child themselves engages in destructive behaviors that jeopardize their health or development, such as substance abuse or criminal activities, and refuses voluntary help. In such cases, social services can request involuntary care under LVU.<\/p>\n\n\n\n

The process in an LVU case<\/h2>\n\n\n\n

Report and investigation<\/strong>
When social services are informed that a child is at risk, they begin an investigation. This involves gathering information from schools, healthcare providers, and others who may have important insights about the child\u2019s situation.<\/p>\n\n\n\n

Decision regarding care<\/strong>
If social services conclude that the child requires involuntary care, they file an application with the administrative court (f\u00f6rvaltningsr\u00e4tten). The court decides on the LVU case and placement after considering the perspectives of both the child and the parents.<\/p>\n\n\n\n

Appeal<\/strong>
Both the child and the parents have the right to appeal the court\u2019s decision. Appeals can be made to the Administrative Court of Appeal (kammarr\u00e4tten) and, ultimately, to the Supreme Administrative Court (H\u00f6gsta f\u00f6rvaltningsdomstolen).<\/p>\n\n\n\n
