By bringing the matter to the UN Committee Against Torture, we are not only protecting our client\u2019s life and rights \u2014 we are also holding Sweden accountable for its international obligations<\/em>,\u201d says <a href=\"https:\/\/kliently.se\/en\/lawyers\/anastasia-martin\/\">Anastasia Martin<\/a>, migration lawyer at Kliently.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case concerns a violation of <a href=\"https:\/\/www.ohchr.org\/en\/instruments-mechanisms\/instruments\/convention-against-torture-and-other-cruel-inhuman-or-degrading\">Article 3 of the UN Convention Against Torture<\/a>, which prohibits the return of individuals to countries where there are substantial grounds for believing they would be in danger of being subjected to torture. The UN has now instructed Sweden to respond to the Committee \u2014 a response the state must submit within six months.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-when-can-a-complaint-be-filed-with-cat\">When can a complaint be filed with CAT?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">CAT is the UN\u2019s monitoring body tasked with reviewing states\u2019 compliance with the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. The Committee accepts individual complaints from people who risk torture in connection with deportation or extradition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A complaint can be submitted to CAT when:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>All domestic remedies in Sweden have been exhausted \u2014 for example, when a deportation order can no longer be appealed.<\/li>\n\n\n\n<li>The case is not being examined by another international body.<\/li>\n\n\n\n<li>There are substantial grounds for believing that the person would face a risk of torture in the country of return.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If CAT decides to examine the case, the person can no longer be deported, usually until the Committee issues its final decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201c<em>Bringing the case before CAT means that the state\u2019s decision is reviewed by an international legal body.
